Terms of Service

1. Accepting these terms

Buying or using any product from HostingAlly(“we”, “us”) means you're on board with everything below. If something here doesn't work for you, the best move is to hold off on using our services.

2. How billing works

Hosting, VPS and domain orders are charged in USD through our billing platform ahead of each upcoming service period. Every hosting plan keeps the exact rate you signed up at when it's time to renew; for a domain with a reduced first-year rate, we'll show the renewal cost right alongside it before you check out. If an invoice goes unpaid past its due date, the service it covers may be paused.

3. Our refund window

Premium and business hosting plans carry a 30-day window to request your hosting fees back, while reseller hosting carries a 7-day window. Domain registrations, VPS and dedicated servers get set up with our upstream providers the moment you order, so once they're live, we're not able to refund them.

4. Keeping things above board

Our services are off-limits for:

• hosting or spreading malware, phishing pages, or unlawful material;
• blasting out unsolicited bulk email, in other words spam;
• attacking, probing, or knocking out other networks or systems;
• hogging resources in ways that slow things down for other customers.

Accounts that cross these lines may be paused or closed; we'll give a heads-up beforehand whenever that's realistic.

5. Staying online & getting help

We aim for 99.9% network uptime. If a given month comes in under that mark because of an issue on our end, you're welcome to ask for a pro-rated credit on your account. Our support desk is staffed around the clock and reachable through tickets.

6. Your content & backups

We run backups every day as a courtesy, but holding onto your own copies of your content is still on you. Past restoring the most recent backup we have available, we can't take responsibility for lost data.

7. Where our responsibility ends

Our services are handed over “as is”. As far as the law allows, the most we'd owe on any claim tops out at whatever you paid for that particular service over the previous three months.

8. Who you are contracting with

HostingAlly is a trading name of Fairdeal Renovations Limited, a company registered in England and Wales under company number 15026869, with its registered office at The Workspace Basildon, 7 High Pavement, Basildon, England, SS14 1EA. Your contract is with Fairdeal Renovations Limited. You can verify the company on the public Companies House register at any time.

9. Governing law and jurisdiction

These terms, and any dispute or claim arising out of them or their subject matter — including non-contractual disputes or claims — are governed by and interpreted in accordance with the law of England and Wales. You and we agree that the courts of England and Wales have exclusive jurisdiction to settle any such dispute or claim.

If you are a consumer, nothing above takes away the protection given to you by the mandatory consumer-protection law of the country where you live, and nothing in these terms limits your right to bring proceedings in your local courts where the law of that country gives you that right. Where the law of your country grants you rights that these terms would otherwise reduce, those rights prevail.

We sell to customers worldwide. It is your responsibility to make sure that buying and using our services is lawful in the country you are in.

10. Your right to cancel

If you are a consumer in the UK or the EU, you generally have a statutory right to cancel a distance contract within 14 days without giving a reason. Our own money-back guarantee is more generous than that: 30 days on hosting plans and 7 days on reseller plans. Offering more does not remove your statutory right, and you may rely on whichever is better for you.

One exception worth stating plainly, because it is easy to be caught out by: domain registrations, renewals and transfers cannot be cancelled or refunded once placed. The registry charges us the moment a domain is registered and that cost cannot be recovered. Our refund policy sets out the full detail.

11. Tax

Prices shown are exclusive of any sales tax, VAT or GST that may apply to you. Where we are required to charge tax on your order, it is calculated and shown at checkout before you pay. Where you are outside the UK and the EU, any tax obligation arising in your own country from buying a service from abroad is yours to determine and settle.

12. Updates to this page

We might revise these terms down the road; any change of real substance will reach you by email or in your client area at least 14 days before it takes hold. Questions along the way? Reach us at info@hostingally.com.
